Terms of Use

These Terms of Use (the “Terms”) govern the use of the SkyGames application (the “Application”), available on mobile and desktop.
By downloading, installing or using the Application, you acknowledge that you have read, understood and unreservedly accepted these Terms. If you do not accept these Terms, do not use the Application.
2. Description of the service
SkyGames is a tool designed to assist with skydiving and wingsuit flying. In particular, the Application allows you to:
- connect to a FlySight device over Bluetooth (BLE) to read and configure it and use its flight data;
- communicate with a Meta Quest 3 virtual reality headset to transfer and visualize flight data;
- record, review and analyze jumps and training sessions.
The Application is an informational and educational tool. It is not jump equipment and is not a safety device.
3. User account
Use of the Application requires creating an account through a Google sign-in (Firebase Authentication service). You are responsible for keeping your credentials confidential and for all activity carried out from your account. You agree to provide accurate information and to keep it up to date.
4. Safety warning — skydiving and wingsuit
Read this section carefully.
Skydiving, BASE jumping and wingsuit flying are inherently dangerous activities that may result in serious injury or death.
The Application is for informational purposes only. It in no way replaces:
- an altimeter or any approved measuring instrument;
- training delivered by a qualified organization;
- the personal judgment, experience and vigilance of the practitioner;
- the applicable safety procedures and rules.
No component of the Application is a certified safety device. The data displayed may be incomplete, delayed, inaccurate or unavailable. You must never base a safety decision solely on the information provided by the Application.
You remain solely and entirely responsible for your jumps, your decisions and your compliance with applicable regulations. By using the Application, you acknowledge and accept these risks.
5. Acceptable use
You agree to use the Application in a personal, lawful manner consistent with its intended purpose. In particular, you must not:
- divert the Application from its intended use;
- attempt to decompile, disassemble or reverse-engineer it, except to the extent permitted by law;
- impair the integrity, security or availability of the service or its systems;
- use the Application for unlawful purposes or in a way that infringes the rights of third parties.
6. Intellectual property
The Application, its code, its interface, its graphics and all of its content remain the exclusive property of the publisher or its licensors. You are granted a personal, non-exclusive, non-transferable and revocable license to use the Application in accordance with these Terms, limited to such use. No transfer of intellectual property rights is granted.
7. Availability and changes
The Application is under active development. The publisher may, at any time and without notice, modify, suspend, limit or discontinue all or part of the Application, add or remove features, or change data formats. No guarantee of continuity, availability or backward compatibility is provided.
8. Liability and warranties
The Application is provided “as is” and “as available”, without warranty of any kind, express or implied, including as to fitness for a particular purpose, accuracy or freedom from error.
To the fullest extent permitted by applicable law, the publisher shall not be liable for any direct or indirect damages arising from the use of, or inability to use, the Application, in particular any decision made on the basis of the information it provides.
Nothing in these Terms operates to exclude or limit the publisher’s liability where applicable law prohibits doing so.
9. Third-party services
The Application relies on third-party services and hardware, in particular:
- Google (Google sign-in and Firebase services);
- Meta Quest headsets;
- FlySight devices.
Use of these services and hardware is subject to the terms and policies of their respective providers, over which the publisher has no control.
10. Personal data
The Application collects and processes personal data. The terms of such processing, the purposes, the recipients and the rights available to you are described in the Privacy Policy, which forms an integral part of these Terms.
11. Changes to the Terms
The publisher may modify these Terms at any time. The applicable version is the one in force at the time you use the Application. Changes take effect upon publication. Continued use of the Application after a change constitutes acceptance of the updated Terms.
12. Governing law and disputes
These Terms are governed by French law. Any dispute relating to their interpretation or performance falls within the jurisdiction of the French courts.
If you are a consumer residing outside France, you additionally benefit from the mandatory consumer-protection provisions in force in your country of residence, from which these Terms may not derogate.
